These Terms of Service (“Terms”) govern your access to and use of WaresPoint.com, including its articles, guides, forums, community features, user accounts, tools, paid services, digital products, artificial intelligence features, and other services made available through Wares Point.

Wares Point is operated by Jeremy Womack in Guthrie, Oklahoma, United States.

By accessing or using Wares Point, creating an account, purchasing a product or service, or participating in the Wares Point community, you agree to these Terms.

7. Moderation

Wares Point reserves the right to moderate its community.

Moderation actions may include:

  • Editing or removing content
  • Moving discussions
  • Closing discussions
  • Restricting posting privileges
  • Issuing warnings
  • Temporarily suspending accounts
  • Permanently terminating accounts
  • Restricting access to particular features
  • Removing spam
  • Removing fraudulent or abusive content

Wares Point is not obligated to publish, maintain, or preserve every user submission.

Moderation decisions may consider community safety, relevance, quality, abuse prevention, legal obligations, and the overall operation of the platform.

Wares Point may take immediate action where reasonably necessary to protect users, the website, or third parties.

8. User-Generated Content

You retain ownership of original content that you submit to Wares Point.

This may include:

  • Images

  • Messages
  • Other original material

By submitting content to areas of Wares Point where it is intended to be displayed, you grant Wares Point a worldwide, non-exclusive, royalty-free license to:

  • Distribute the content through Wares Point

This license exists so Wares Point can operate the service and display the content you chose to submit.

You do not transfer ownership of your original content to Wares Point.

9. Responsibility for User Content

You are responsible for content you submit.

You represent that you have the necessary rights to submit your content and allow Wares Point to use it as described in these Terms.

You may not knowingly submit content that:

  • Infringes another person's copyright
  • Infringes trademarks or other intellectual property
  • Violates privacy rights
  • Violates contractual obligations
  • Contains malicious software
  • Is fraudulent or intentionally deceptive

Deleting your account or deleting a post cannot guarantee that copies previously made by third parties will disappear.

16. Refunds

Termination of an account does not necessarily erase all information associated with the account immediately.

Public discussion content may remain where removal would disrupt existing conversations, subject to applicable privacy rights and Wares Point policies.

Where liability cannot legally be excluded, liability will be limited to the maximum extent permitted by applicable law.

Nothing in these Terms excludes liability that cannot legally be limited or excluded.

33. User Responsibility

This provision does not require you to indemnify Wares Point for conduct for which indemnification cannot legally be required.

38. Disputes and Venue

Before filing a formal legal claim, users are encouraged to contact Wares Point at sales@warespoint.com and attempt to resolve the issue informally.

Unless applicable law provides otherwise, legal proceedings arising from these Terms or use of Wares Point will be brought in a court of competent jurisdiction serving Logan County, Oklahoma or another court having proper jurisdiction over the dispute.

Nothing in these Terms prevents either party from seeking relief in small claims court where permitted.

These Terms do not require mandatory private arbitration.

39. Severability

If any provision of these Terms is determined to be invalid or unenforceable, the remaining provisions will remain in effect.

The invalid provision will be interpreted or limited to the extent necessary to make it enforceable where permitted by law.

40. No Waiver

Failure by Wares Point to enforce a provision of these Terms does not waive the right to enforce that provision later.

41. Entire Agreement

These Terms, together with the Wares Point Privacy Policy and any additional policies or purchase-specific terms expressly incorporated into them, constitute the agreement between you and Wares Point concerning your use of the service.

If specific terms presented for a paid product conflict with these general Terms, the product-specific terms will control for that particular purchase to the extent of the conflict.

42. Assignment

You may not transfer your rights or obligations under these Terms to another person without consent where consent is legally required.

Wares Point may transfer its rights and obligations in connection with a sale, restructuring, transfer of the business, or similar transaction, subject to applicable law.

43. Electronic Communications

By using Wares Point, you consent to receiving communications electronically where legally permitted.
